We have defended and prosecuted declaratory judgment matters involving a broad range of insurance coverages, including commercial general liability, professional errors and omissions, business interruption, builder’s risk, homeowners, business and personal umbrella and property insurance.
We have a particular expertise in providing coverage opinions and litigating disputes involving both primary and excess general liability policies. Our attorneys have significant experience with nearly all aspects of general liability coverage, including unique problems arising from the defense obligation, additional insured endorsements, insured contract provisions, “other insurance” provisions, the insured’s work and product exclusions, conflicts of interest arising from the insurer’s reservation of rights, coverage triggers and the stacking of multiple coverages. We have evaluated defense and indemnity issues in the context of a wide variety of liability scenarios, including construction injury, junk-fax cases, product liability, advertising injury, copyright infringement, wrongful eviction, sexual battery and vehicular mishaps. We have also been successful in developing and implementing creative solutions to coverage disputes in order to avoid the expense of prolonged litigation.
Additionally we have extensive experience in property coverage issues, including matters involving allegations of arson, fraudulent inducement, bad faith, valuation disputes, extra expense claims, floods, mold and application of virtually all types of policy exclusions.
